Whereas the pieces or parcel of land more fully described in the schedule hereto and commonly known as the KUMBRAHOLLI ESTATE belonged to absolutely to Mr. GEORGE CYRIL ORLEBAR and where by him conveyed by way of sale as per indenture dated the 3 rd day of January 1927 and registered on the 4 th January 1927 as No.350 of book Volume 182, pages 360 to 373 by the sub registrar of manjaarbad, Mysore province, to Mr.Lionel Newcome son of George Henry Newcome and Cyril Arthur Reid, son of John Reid; and whereas the above said Lionel Newcome later transferred all his ( Lionel Newcome’s) claims as co-owner with the above said Cyril Arthur Reid to the above named Cyril Arthur Reid under a deed of indeture dated 31 st day of july 1929 and registered as no.73 of 1929/30 between pages 354 and 373 of volume 197 book 1 by the Sub registrar of Manjarbad, and where as the said Kumbarahalli Estate was mortgaged by the said Cyril Arthur Reid to the vendors herein, as per deed mortgage dated 30 th july 1929, and whereas by an indenture dated the 8 th September 1931 and registered on the 27 th November 1931 as document no.232/31-32 book no.1 volume 210 pages 28 to 49 the said Cyril Arthur Reid conveyed his rights as owner of the kumbarahalli Estate.
to the vendors and put them in possession of the same and when as vendors are now by virtue of the above indenture and acts absolutely entitled to and possessed of the place and parcels of land hereby conveyed to the purchaser and described more fully in the schedule hereto and commonly know as Kumbarahalli Estate; and whereas it was agreed as the said Cyril Arthur Reid to the purchaser for the sum of Rs.10,000/-(ten thousand only)
Now there for the vendors in the pursurance of the said agreement and for the consideration of Rs.10,000/- only recited above the receipt of which sum the vendors hereby acknowledge hereby convey and assign unto the purchaser all those pieces or parcel of land described more fully in the schedule hereto and commonly known as Kumbarahalli Estate together with all buildings, sheds and other erections standing and being on the said Estate premises and all coffee and other trees, coffee seedlings and other plants coffee and other crops and produce now growing on the said Estate and all woods , jungles , gutters water drains water courses fences hedges ditches rights privileges easements advantages and appurtenances what so ever to the said premises or any part there of now or hereto enjoyed or reputed or know part and parcel of them or any of them or as appurtenant thereto; And all the estate right titerest claims and demand of the vendors into and upon the same. To have and to hold the saerces or parcel of lands and buildings and all and singular other premises here in before to be conveyed and assigned unto the purchaser his assigns or administrators for ever suits the same terms upon which the same are now vested in the vendors; And the vendors do hereby with the purchaser that not with standing anything by them. The vendors done or knowling the vendors have full par to convey and assign all the singular and said premises and the right and interest in the same here in before expressed to be here by conveyed and assigned to purchaser.
The vendors have not been privy to anything where by the said premises or part thereof is or may be impeached affected or encumbered in title estate or other wise how so whereby the vendors r anywise hindered from conveying or assigning the said premises or any there of respectively in any manner afore said. That the vendors have the covenant that they shall power to convey and assign all and singular the said premises here in before expressed to be conveyed and assigned to the purchaser., and the vendors have not been privy to anything where by the said premises or there of is or may be impeached affected or encumbered in title estate or other wise .
